• Prices are expressed in euros. The sites are for informational purposes only; these prices are not binding.
• The Company reserves the right to modify these general terms of sale at any time and at its sole discretion.
• Buyer places an order on the Site.
• The validation of an order by the Buyer implies the irrevocable acceptance of these general terms, which are considered read and accepted by the Buyer upon order confirmation.
• To place an order for tickets on sale, the Buyer must guarantee that they are of legal age and have full legal capacity to place an order on the Site.

I Object:
The purpose of these general terms of sale is to define the terms and conditions of sale to the Buyer, as well as the obligations of both parties.

Under certain circumstances, the ticket may be transferred to another person as a gift, provided the Company is informed. Therefore, we consider that the ticket holder accepts our general terms of sale.

II Entry into Force / Duration:
These General Terms come into effect upon the Buyer placing the order and remain valid until the expiration of the rights and obligations assumed by either party.

III The ticket includes:

• A hot air balloon flight lasting 1 hour, including the meeting point up to the balloon boarding location.
• The pre-flight safety briefing.
• A hot air balloon flight lasting 45 minutes to 1 hour, depending on the chosen flight.
• Flight certificate.
• Post-flight toast.
• Transportation from the meeting point by vehicle.
• Air transport liability insurance.

IV Order:
The Buyer agrees to receive information related to their order and its fulfillment via email.

V Withdrawal:
Possibility of right of withdrawal for the sale of hot air balloon tickets.
The Buyer has the right to withdraw from the order placed on the mentioned website. In case of withdrawal, the refund of the amount paid will be processed if the cancellation is successfully made at least 10 days before the scheduled flight date. Unused orders will not be refunded.

The Company reserves the right to cancel the order, without refund, if the following conditions occur:

• The ticket is presented in poor condition or is illegible.
• The ticket is used fraudulently.
• The ticket is valid for more than one calendar year from its issuance, according to the conditions detailed herein.
• Promotional tickets or tickets with “fixed date value” or “non-refundable 10 days before the flight” not used within the specified period.

VI Payment:
The price of the services offered for sale is indicated in euros, including VAT and air transport liability insurance.

The prices are listed on the Site and may be changed at any time. The price applicable to the Buyer will be the one in effect at the time the order is confirmed.

VII Requirements:
No one has the right to board a hot air balloon without holding a ticket. Any regular air transport company may transport its passengers within Warsaw. The pilot is the only one who decides the take-off site, the flight duration, and whether the balloon can fly or not. They may detach a capsule, passengers, or the entire balloon if they consider that the required safety conditions are not met. This decision does not entitle the passenger to any refund.

VIII Insurance:
Each passenger is insured under the civil liability coverage related to the aircraft used. The risks are covered by amounts comparable to those required by European regulations for air passenger transport. Items carried by passengers are not covered by our insurance providers nor by us.

IX Conditions for canceling a flight:

• The flight may be canceled at the initiative of the Company for any safety reason (including changing the take-off location or canceling up to the moment of take-off), due to poor weather conditions, wind direction and speed, or local conditions. In such cases, the ticket may be rescheduled in agreement with the customer within 12 months following the cancellation date.
• The Company is not responsible for any expenses incurred by its customers other than the hot air balloon ticket in cases of flight cancellation by the Company.
• A customer who is not present at the meeting point at the agreed time forfeits their right to the flight, with no right to a refund.
• The voucher is valid for a period of 12 months, paid in the amount of 60 euros.
• Except in cases of bad weather, flight cancellations will be made for reasonable weather-related safety reasons; in such an event, the passenger must reschedule in accordance with the Company's flight schedule. If the flight cannot take place within 12 months, the customer must pay a renewal fee of 60 euros to extend the validity of the ticket.
• If the customer wishes to voluntarily cancel their reservation within 10 days of the flight or from the day the ticket is issued and the service has not been used, they will receive a full refund.
• In the event of cancellation by the buyer without rescheduling, a refund will be issued within the 20 days prior to the flight date and only if previously authorized by the Company. The refund amount will be the ticket value minus operational fees. The refund does not include commissions or fees paid by the customer via bank card or other related charges.

X Flight conditions:
Flights are carried out under weather conditions deemed suitable by the pilot. We do not guarantee specific routes or flyover locations, as they depend entirely on wind conditions.

• The flight duration is not guaranteed.

• The flight duration will be determined by the pilot, and the passenger may not claim any rights regarding it. Only flights lasting less than 20 minutes without a technical or weather-related reason will be eligible for a refund.
• Passengers must follow all instructions given by the pilot without exception. Smoking during the flight is strictly prohibited. Strict discipline must be maintained inside the balloon, with no joking or any dangerous behavior.
• The company reserves the right to deny participation to any person under the influence of alcohol or psychotropic substances. In such cases, no refund will be issued. In the case of intoxication, smoking is also prohibited during boarding and the flight. The pilot may refuse the flight and boarding of the passenger.

XI Restrictions:
For safety reasons, the passenger’s physical condition, fitness, and agility are taken into account for the flight. It is the passenger’s responsibility to follow the pilot’s instructions. In case of doubt, the customer must provide a medical certificate confirming their fitness to fly. Pregnant women and individuals with heart conditions are not accepted.

Passenger restrictions:

• Children must be taller than 1.20 meters.
• Children under 6 years old must be accompanied by an adult.
• Children and minors must be declared by their accompanying adults at the time of registration.

• Animals are not allowed on the flight.

XII Force majeure:
The Company's obligations will be suspended in the event of force majeure, and the Buyer may not hold the Company liable.
Specifically, the following shall be considered force majeure or unforeseeable circumstances, in addition to those typically recognized by the jurisprudence of national courts and tribunals: total or partial strikes, whether internal or external to the company (especially postal service strikes), theft, bad weather, epidemics, earthquakes, fires, storms, floods, water damage, telecommunications or internet outages, governmental or legal restrictions, legal or regulatory changes affecting commercial practices, and any other situation beyond the express will of the parties that prevents the normal execution of this contract.

XIII Acceptance of these terms:
Any order implies full acceptance of these terms.

XIV Competent courts:
The competent courts in the event of legal action shall be the courts of the Málaga region.
